ENDEMiGO AUCTION - ONLINE AUCTION GENERAL TERMS AND CONDITIONS

1. SHIPPING AND DELIVERY

1.1. Endemigo Auction offers same-day or next-day delivery service across Turkey through UPS, Yurtiçi Kargo, or Sürat Kargo. International shipments are based on the regions covered by UPS; regions outside this coverage must be discussed with customer service.

1.2. Works prohibited from export under the Law on the Protection of Cultural and Natural Property cannot be subject to international shipping. All other products may benefit from free domestic shipping and insured transport advantages, subject to our promotional and sales policies.

1.3. When the product is dispatched, an information email containing a tracking number is sent to the customer; upon delivery, a delivery confirmation email is sent. An adult signature is required for all deliveries.

1.4. Special handling or packaging requests may be accommodated at the sole discretion of Endemigo Auction and for an additional fee.

1.5. Following receipt of payment, products shall be shipped within ten (10) business days at the latest, except in cases of force majeure. In the event of delivery delays, the customer will be informed and offered alternative solutions.

1.6. Products returned as a result of an incorrectly declared address, absence of the recipient, or refusal of delivery will be taken back; in such cases, the re-shipping fee shall be borne by the customer.

1.7. Freight, customs duties, and taxes for international shipments are the responsibility of the winning bidder. The customer acknowledges that insurance coverage may vary from country to country and that insurance may be limited or unavailable in certain countries.

1.8. In the case of payment via wire transfer/EFT, the product can be shipped to the requested address. When payment is made by credit/debit card, the product will only be directed to the billing/address information declared during payment. Address change requests must be supported by proof of residence or billing documentation and sent to [email protected].

1.9. Endemigo accepts no liability for damage or loss arising during transit if the official carrier tracking records indicate that the item was delivered. Otherwise, the right to send a replacement product of similar quality or issue a refund is reserved.

2. PAYMENT TERMS

2.1. Winning bidders are obliged to pay the total amount, including the hammer price, buyer's premium, VAT, and other legal obligations, within forty-eight (48) hours at the latest.

2.2. Payment Methods:

– Visa, MasterCard, American Express

– Wire transfer / Bank transfer

– Bank payment link

– Digital payment systems compliant with Turkish regulations

2.3. For credit card payments, transaction fees may be reflected by the bank or payment provider. Bank transfer may be preferred for transactions exceeding 5,000 USD or its TL equivalent.

2.4. In the event of non-payment, Endemigo reserves the right to cancel the item, block refunded funds, or exchange it with a similar product.

3. ACCEPTED PAYMENT METHODS

Unless stated otherwise, the payment methods valid for every auction are:

– Bank Payment Link

– Digital Payment Systems

4. AUTOMATIC PAYMENT

An automatic payment system is utilized in select auctions. Once the auction concludes, the winning bid amount may be charged directly from the card or deducted from the deposited amount.

5. SALES TAXES

5.1. All transactions are subject to VAT, withholding tax, and other taxes pursuant to the applicable Tax Procedural Law and related regulations.

5.2. Users who do not submit the required documents for tax exemption in advance shall not benefit from the exemption.

6. LEGAL BINDINGNESS

Participating in the auction and placing a bid constitutes entering into a binding contract with Endemigo. Submitted bids cannot be withdrawn, and every bid creates legal liability.

7. BUYER'S PREMIUM

Unless stated otherwise, a 10% buyer's premium applies to every lot sold. For example, a 10 TL buyer's premium is added to a 100 TL bid price.

8. RESERVE PRICES

8.1. Endemigo may apply confidential reserve prices. Bids that do not reach the reserve price result in the cancellation of the sale of the item.

8.2. In unreserved auctions, the sale takes place regardless of the highest bid amount.

9. BUY IT NOW SYSTEM

Items may be offered for sale before or after the auction at a "Buy It Now" price. These prices are specified on the product page.

10. ITEM CONDITION

10.1. Items are sold "as is" and are pre-owned/second-hand in nature. There may be minor deformations and signs of use.

10.2. Photographs reflect the general condition of the item; color variations may result from monitor settings.

11. RETURNS AND EXCHANGES

11.1. Sales conducted through auction procedures are not subject to the right of withdrawal under Law No. 6502.

11.2. If the product description does not reflect reality, store credit, a similar product, or a refund may be offered to the customer as an option. Requests must be reported to [email protected] within 3 (three) business days from the delivery date.

12. DISCLAIMER

Endemigo provides no express or implied warranties regarding the authenticity, quality, condition, or rarity of the works. Descriptions and reports do not constitute binding documentation.

13. WATCHES AND KNIVES

Collectibles such as watches, knives, and similar items are sold as pre-owned; original box, warranty certificate, or factory warranty may not be present.

14. FURNITURE AND HOME GOODS

14.1. Furniture and antique items are sold "as is"; items may contain defects and signs of aging.

14.2. International shipping is not available for these items. They may be picked up from local delivery centers.

15. ANTIQUE AND COLLECTIBLE PRODUCTS

15.1. Sales are limited to stock, and real-time stock availability applies.

15.2. In the event of a discrepancy between the description and the images, the written description shall prevail.

16. GENERAL CONDITIONS OF WAIVER

By registering electronically and placing a bid, the participant declares that they have read, understood, and accepted these terms and conditions.

17. LIMITATION OF LIABILITY

Endemigo shall not be held liable for damages arising from system errors, logistics delays, actions of third-party service providers, or force majeure events.
